Drug Free Workplace

POLICY BRIEF AND PURPOSE

The “Substance Abuse” policy of TreborAsia Insurance Adjustment Services have been enhanced pursuant to Quezon City Ordinance No 2791 Mandating Business Establishments within the territorial jurisdiction of Quezon City to Adhere to “A Drug-Free Quezon City.” It shall be named “Drug Free Workplace Environment policy”

TreborAsia Insurance Adjustment Services will establish safeguards against drug abuse to ensure a safe and healthy working environment. Substance abuse imposes a burden on those caught up in the abuse, but also on their co-workers. It may lead to poorer job performance and accident risks.

To mitigate these risks, the company in cooperation with the Quezon City Government have developed this Drug Free Workplace policy to prohibit the use, possession or sale of drugs on company premises.

POLICY ELEMENTS

TreborAsia Insurance Adjustment Services promotes fair and safe working environment both for our employees and guests thus we will not condone the use, possession and selling of illegal substance within the office premises and elsewhere company or work related events are being conducted.

PROCEDURE

Thru the approval of the Quezon City Local Government Unit and Quezon City Anti-Drug Abuse Advisory Council, TreborAsia Insurance Adjustment Services shall observe the following procedures:

CONDUCTING OF DRUG TEST / DRUG USE CONFIRMATION

  • Schedule
    • TreborAsia Insurance Adjustment Services shall conduct a MANDATORY RANDOM DRUG TESTING on all its employees on an annual basis. The schedule of testing shall be within the second quarter of every calendar year with no definite or permanent date.
      TreborAsia Insurance Adjustment Services shall also subject its probationary employees to mandatory drug testing before regularization.
  • Facility
    • TreborAsia Insurance Adjustment Services shall require the services of Central Medical Laboratory & Asthma Therapy, a Department of Health accredited facility, to conduct the Mandatory Random Drug Testing.

  • Sampling
    • The company reserves the right to determine the maximum number of the employees to undergo the testing depending on it financial capacity. However, Ten Percent (10%) shall be its minimum base to be observed.
  • Selection
    • To observe the fair and just selection in the drug testing, the determination of the employee shall be conducted thru draw lots which will be conducted in the presence of both the management and the employee body.
      The employee who will be selected shall be accompanied by one of the management team to a Department of Health accredited facility for testing the same day of the selection.
  • Costing
    • TreborAsia Insurance Adjustment Services shall pay for all the expenses incurred in conducting the Mandatory Random Drug Testing, both the actual drug test and the confirmatory test.
  • If an employee refuses to undergo mandatory drug testing
    • The management reserves the right to put the employee concern to sanction under the insubordination clause.
      The company shall submit a report to the Department of Labor and Employment on how the subject matter was handled most especially if the circumstances resulted to the termination of the contract of the employee.
  • Drug Testing
    • When an employee subjects to mandatory drug testing, a member of the management team shall accompany him/her to the Department of Health accredited facility.
      The management team shall inform the facility of the procedure and how the result shall be relayed to. The management team shall inform the concerned employee whatever the result of the test.
      Both the management team and the employee are bound to confidentiality of the result of test.

    If an employee is found positive, the result shall be sent to the Quezon City Anti-Drug Abuse Advisory Council where he/she will be referred to for intervention and counseling.

  • If an employee is found positive the first time
    • The employee shall be endorsed to QCADAAC for profiling, rehabilitation and/or counseling.
      The employee shall be put to a mandatory Medical Leave during the duration of the rehabilitation.
      The employee may opt to use his/her remaining leaves for the calendar year during the duration of the rehabilitation. If the employee were able to use all of his/her remaining leaves, the company will not compensate the employee for the remainder of the Medical Leave.
      The company will still be paying for the employee’s statutory obligations (SSS, Philhealth & PAGIBIG) during the duration of the Medical Leave.
      The company reserves the right to hire a temporary replacement for the concerned employee during the duration of the Medical Leave
      The employee shall secure “A fit to work order” from QCADAAC for the company to resume his/her employment.
      The employee is required to be included in the roster for mandatory drug testing the following calendar year.
      The company reserves the right to require the concerned employee to another drug testing within the same calendar year if it finds it necessary.
  • If an employee is found positive the second time
    • TreborAsia Insurance Adjustment Services reserves the right to terminate the contract of the employee on the grounds of insubordination.
      The company shall coordinate with the Quezon City Anti-Drug Abuse Advisory Council and the Department of Labor and Employment regarding the terminaton.
      All necessary compensation shall be provided by the company in accordance with the law on termination of employment contract.

    POSSESSION AND / OR SALE OF ILLEGAL SUBSTANCE

    Pursuant to Section 5, 11 and 13 of RA 9165 or the Comprehensive Dangerous Drugs Act of 2002, TreborAsia Insurance Adjustment Services shall report any of its employees that are found possessing or participating in the selling and transportation of illegal substance to the Quezon City Police District.

    The company shall also welcome inspection with search warrant to its office premises from the directives of the QCPD.

    The management shall also welcome any investigation and litigation in any court of law in the Philippines in connection with its employees’ violation of the above mentioned sections of RA 9165.

    EDUCATION

    TreborAsia Insurance Adjustment Services shall provide continuous education to its employees regarding, health care, mental health, and the effects of substance abuse. It will enhance its open door policy to be able to provide assistance to its employees who needs counseling.

    The company shall post a signage in its premises declaring it a ‘DRUG FREE ZONE” as mandated by the Quezon City Local Government Unit.

    COMPLIANCE

    TreborAsia Insurance Adjustment Services shall be in continuous coordination with the following government offices to make sure that the Drug Free Workplace policy is updated and compliant:

  • Quezon City Police District
  • Department of Labor and Employment
